Right of withdrawal for consumers in the EU and EEA
Right of withdrawal for consumers in the EU and EEA
Last updated: 11 September 2026. This page applies to consumers resident in the European Union and the European Economic Area. It sets out the information we are required to give you under Article 6(1)(h) of Directive 2011/83/EU on consumer rights, and it includes the model withdrawal form.
Diabec is a trading name of Nibartech Ltd, 3 Hornton Place, London W8 4LZ, United Kingdom, company registration number 15283998. You can reach us at contact@dia-bec.com.
1. Your right to withdraw
If you are a consumer in the EU or EEA, you have the right to withdraw from your purchase within 14 days without giving any reason.
You do not have to explain why. You do not have to justify the decision. We will not ask you for a reason, and any answer you choose to give us is voluntary.
2. When the 14 days start and end
The withdrawal period expires 14 days from the day on which you, or a third party other than the carrier that you have named, acquire physical possession of the goods.
- If you ordered several items in one order and they are delivered separately, the 14 days run from the day you receive the last item.
- If you ordered goods that are delivered in several lots or pieces, the 14 days run from the day you receive the last lot or piece.
- For a subscription that delivers goods regularly over a defined period, the 14 days run from the day you receive the first delivery.
To meet the deadline it is enough that you send your notice of withdrawal before the 14 day period has expired.
3. How to withdraw
You can withdraw in any of these ways. All of them are equally valid.
- Use the withdrawal function on this website. The link Withdraw from contract here (EU) appears in the footer of every page. It takes you to a short form, asks you to confirm, and we email you an acknowledgement immediately. This is the fastest route and it gives you a written record with a timestamp.
- Email us at contact@dia-bec.com with any clear statement that you are withdrawing. You may use the model form in section 7 below, but you are not obliged to.
- Write to us at Nibartech Ltd, 3 Hornton Place, London W8 4LZ, United Kingdom.
Whichever route you use, we will send you an acknowledgement of receipt without undue delay, on a durable medium, confirming what you told us and the date and time we received it.
4. What happens after you withdraw
We will reimburse all payments received from you, including the standard delivery charge you paid, without undue delay and in any event no later than 14 days from the day we are informed of your decision to withdraw.
We will make the reimbursement using the same means of payment you used for the original transaction, unless you have expressly agreed otherwise. You will not incur any fee as a result of the reimbursement.
Where you chose a delivery option more expensive than our cheapest standard delivery, we reimburse the cost of the cheapest standard delivery we offer, not the premium option.
5. Returning the goods
You must send the goods back to us without undue delay and in any event not later than 14 days from the day you communicate your withdrawal to us. The deadline is met if you send the goods before the 14-day period has expired.
- You bear the direct cost of returning the goods. We recommend a tracked service and we ask you to keep the proof of postage.
- Return address: Nibartech Ltd, 3 Hornton Place, London W8 4LZ, United Kingdom. The acknowledgement email repeats this address together with your reference number, which you should write on the parcel.
- We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent them back, whichever is the earlier.
- You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish their nature, characteristics and functioning.
6. The one exception, and how we handle it
Under Article 16, first paragraph, point (e) of Directive 2011/83/EU, the right of withdrawal does not apply to sealed goods which are not suitable for return for health protection or hygiene reasons, where the seal has been broken after delivery. Our capsules are sealed for exactly that reason.
In practice this means:
- A sealed, unopened bottle carries the full right of withdrawal, without qualification.
- Where a bottle was opened after delivery, we may not be able to reimburse that particular bottle. We assess that afterwards, on the individual facts, and we tell you the outcome in writing with our reasons.
- This never prevents you from sending the notice. Your withdrawal notice is always accepted and always acknowledged. Nothing on our form asks you to confirm the seal before you can submit, and no answer you give can block the submission.
7. Model withdrawal form
You only need to complete and return this form if you wish to withdraw from the contract. You are free to use your own wording instead, or to use the withdrawal function on this website.

Where anything in our Refund Policy, Terms of Service, Shipping Policy or cancellation terms is less favourable to you than this page, this page applies and those terms do not. Nothing in our terms limits or removes your statutory rights as a consumer in the EU or EEA.

If you are not satisfied with how we have handled a withdrawal, write to us first at contact@dia-bec.com and we will respond. You may also contact the consumer protection authority in your country of residence, or use the European Consumer Centre network in your member state.
